Terms and Conditions of Use – Magasin Zaprada
Article 1 – Definitions
In these terms, the following definitions apply:

Withdrawal period: the period during which the consumer may exercise their right of withdrawal.

Consumer: the natural person who is not acting in the course of a profession or business and who enters into a distance contract with the entrepreneur.

Day: calendar day.

Distance contract: a contract regarding a range of products and/or services in which the delivery or purchase obligation is carried out remotely.

Durable medium: any means that allows the consumer or entrepreneur to store information for future consultation, unchanged.

Right of withdrawal: the option for the consumer to cancel the distance contract within the reflection period.

Entrepreneur: the natural or legal person offering products and/or services to consumers.

Distance communication technology: any method that can be used to conclude a contract without the consumer and entrepreneur being physically present in the same place.

Article 3 – Applicability
These terms and conditions apply to all offers from the entrepreneur and to all distance contracts concluded between the entrepreneur and the consumer. The text of these terms will be made available to the consumer before the conclusion of any distance contract. If the contract is concluded electronically, the terms will be made accessible in a way that allows the consumer to store them on a durable medium. If this is not possible, a copy will be sent to the consumer upon request.
Article 4 – The Offer
If an offer is subject to a validity period or specific conditions, this will be clearly stated. The offer includes a complete and accurate description of the proposed products and/or services. Obvious errors or mistakes in the offer are not binding on the entrepreneur. Product images are representative, but we cannot guarantee that the displayed colors exactly match the actual product colors.
Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and meets the specified conditions. If the consumer accepts the offer electronically, the entrepreneur will immediately confirm receipt of this acceptance. The entrepreneur will take appropriate measures to protect the electronic transmission of data and ensure a secure online environment. If payment is made electronically, adequate security measures will be implemented.
Article 6 – Right of Withdrawal
When purchasing products, the consumer has the right to cancel the contract within 14 days without giving any reason. The reflection period begins the day after the consumer receives the product. During this period, the consumer must handle the product and packaging with care. To exercise the right of withdrawal, the consumer must notify the entrepreneur within the specified time and return the product according to the instructions provided.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, they are responsible for the direct return shipping costs. The entrepreneur will refund the amount paid by the consumer as soon as possible, and no later than 14 days after cancellation, provided that the products have been received or the consumer can provide proof of return.
Article 8 – Exclusion of the Right of Withdrawal
The entrepreneur may exclude the consumer’s right of withdrawal in the following cases:

Customized or personalized products;

Products with a broken safety seal (e.g., hygiene items);

Perishable goods or those with a limited shelf life.
Article 9 – Pricing
During the validity period of the offer, product and/or service prices will not be increased, except due to changes in applicable tax or duty rates. Prices listed do not include import taxes or customs fees, which are the responsibility of the consumer.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that the products and/or services conform to the contract and the specifications listed in the offer. Legal warranty applies in case of manufacturing defects or damaged products. If a defect is discovered, the consumer must notify the entrepreneur within 14 days of delivery.
Article 11 – Delivery and Execution
The entrepreneur commits to handling product orders with care. Products will be delivered to the address provided by the consumer, within the time specified in the offer. In case of delay or product unavailability, the consumer will be notified and has the right to cancel the contract and receive a full refund.
Article 12 – Payment
Amounts due by the consumer must be paid within 7 days of order confirmation. The consumer must report any errors in the payment information immediately.
Article 13 – Complaints
Complaints regarding the execution of the contract must be submitted to the entrepreneur within 7 days of identifying the issue, in a complete and clear manner. The entrepreneur will respond to complaints within 14 days.
Article 14 – Governing Law
Contracts between the entrepreneur and the consumer are governed exclusively by Brazilian law.
